These Terms of Service ("Terms") govern your access to and use of the website at gardenbutcher.com and the in-store and online ordering, catering, loyalty, and related services provided by Garden Butcher ("Garden Butcher," "we," "us," or "our") (collectively, the "Services").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order or create an account. By using the Services you represent that you meet this requirement and that the information you provide is accurate.

Orders and payment

All orders are subject to acceptance and availability. We may refuse or cancel an order at any time, including if an item is unavailable, pricing is incorrect, or we suspect fraud.
Prices, menus, and availability may change without notice.
Payment is due at the time of purchase. Payments are processed by our third-party payment processors, and you agree to their terms in addition to these Terms.
You are responsible for any applicable taxes, fees, and gratuities shown at checkout.

Pickup, delivery, and catering

You are responsible for providing accurate pickup, delivery, and contact information. We are not responsible for delays or failed deliveries caused by incorrect information.
Delivery may be fulfilled by third-party partners, whose terms also apply.
Catering orders may require advance notice, deposits, and minimum order amounts. We will communicate any such requirements when you book.

Cancellations and refunds

If you need to change or cancel an order, contact us as soon as possible. Refunds and credits are handled on a case-by-case basis and may depend on the status of your order and any applicable partner policies. Prepared food is perishable, so some orders may not be eligible for cancellation once preparation has begun.

Loyalty program

If you participate in our loyalty program, points, rewards, and benefits have no cash value and may be changed, limited, or discontinued at any time. We may adjust or revoke rewards we believe were obtained through error, abuse, or fraud.

Food allergies and safety

We handle and prepare a variety of foods, and cross-contact with allergens can occur. If you have a food allergy or dietary restriction, contact us before ordering. You are responsible for confirming that menu items are appropriate for your needs.

Acceptable use

You agree not to:

To the fullest extent permitted by law, Garden Butcher and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the order giving rise to the claim.

You agree to indemnify and hold harmless Garden Butcher and its owners, employees, and partners from any claims, damages, losses, and expenses arising out of your use of the Services or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Florida, unless applicable law requires otherwise.
